These Terms of Service explain the rules for using RoadHistorical. They are written to be read — plain English where possible, legalese only where necessary. Please also see our Privacy Policy, which describes how we handle your data.
Acceptance of These Terms
By downloading, accessing, or using the RoadHistorical mobile application (the "App") or the RoadHistorical website at roadhistorical.app (together, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. The Service is operated by RoadHistorical LLC ("we," "us," or "our"), a Texas limited liability company.
What RoadHistorical Is
RoadHistorical helps you discover Texas historical markers and points of interest while you travel. The App shows nearby markers based on your location, provides historical context and narration, and lets you save places you have visited. The website provides articles, maps, and other content about Texas road history.
Your Account
Some features require an account. Authentication is handled through Firebase Authentication (Google LLC). You are responsible for keeping your login credentials secure and for all activity that happens under your account. You must provide accurate information when creating an account.
You can delete your account at any time from within the App, or by following the instructions on our account deletion page. Deleting your account removes your saved data as described in our Privacy Policy.
RoadHistorical+ Subscriptions
Plans and Billing
RoadHistorical+ is an optional auto-renewing subscription that unlocks premium features. It is offered as a monthly plan ($5.99/month) and an annual plan ($39.99/year). Subscriptions are purchased through the Apple App Store or Google Play, and all billing is handled by your store — we never see or store your payment details. Prices are in U.S. dollars and may vary by region; your store shows the exact price before you confirm a purchase.
Auto-Renewal
Your subscription renews automatically at the end of each billing period (monthly or yearly, depending on your plan) unless you cancel at least 24 hours before the current period ends. Your store charges the renewal to your payment method on file.
Free Trials
We may offer free trials — currently, a 7-day free trial is planned for the annual plan. If you start a trial and do not cancel before it ends, it automatically converts to a paid subscription and your store charges you for the plan you selected.
Cancellation
You can cancel anytime through your App Store or Google Play subscription settings — not through the App itself. When you cancel, you keep RoadHistorical+ access until the end of the period you have already paid for, and you will not be charged again. We do not offer partial refunds for unused time; refund requests are handled by your store under its policies.
Price Changes
If we change subscription prices, you will be notified in accordance with your store’s policies, and the new price will only apply if you accept it or your store’s rules otherwise allow the change at renewal.
Acceptable Use
You agree to use the Service only for lawful, personal, non-commercial purposes. You must not:
- Use the Service while driving in a way that distracts you from the road or violates traffic laws
- Copy, scrape, resell, or redistribute the Service or its content without our permission
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Interfere with or disrupt the Service, its servers, or other users
- Use the Service to harass others, trespass on private property, or damage historical sites or markers
- Impersonate another person or misrepresent your affiliation with anyone
Location Data and Safety
The App uses your device’s location to show nearby historical markers. Always drive safely: do not interact with the App while your vehicle is in motion, and pull over legally before reading marker details. Location data, directions, and marker positions are provided as-is and may be inaccurate or out of date — verify road conditions, access, and legality before visiting any site. Some markers are on private property or in areas that are unsafe to stop; you are solely responsible for your own safety and for complying with traffic laws and property rights.
Historical Content
Historical information in the Service — including marker text, summaries, narration, and articles — is provided for general informational and educational purposes only. While we work from sources such as the Texas Historical Commission’s marker records, we do not guarantee that any content is accurate, complete, or current, and it should not be relied on as authoritative historical scholarship.
Third-Party Services
The Service depends on third-party services, including Google Maps, Firebase, the Apple App Store, and Google Play. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their availability or conduct. Links to third-party websites are provided for convenience and do not imply endorsement.
Intellectual Property
The Service — including the App, website, design, logos, text, audio narration, and software — is owned by RoadHistorical LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for its intended purpose. Historical marker inscriptions and public records remain in the public domain or under their original terms.
Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content will be accurate or reliable.
Limitation of Liability
To the maximum extent permitted by law, RoadHistorical LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, personal injury, or property damage — arising from your use of the Service, including your travel to or from any location shown in the App. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose, or $50 if you have paid nothing.
Indemnification
You agree to indemnify and hold harmless RoadHistorical LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you through the App or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
